Anthropic recently published a 23,000-word "constitution" governing how Claude should behave. It's a formal document outlining priorities, boundaries, and decision-making frameworks for their AI system.
How many words is your company's AI policy?
If the answer is zero, you're not alone. But there's good news: building one is more straightforward than you might think, and getting it right ensures your teams have clear guidance on how they can interact with these new tools.
Shadow AI Is Already in Your Organization
Here's the reality: your employees are already using AI. The question isn't whether to allow it. It's whether you're going to shape how it happens.
I started paying attention to this because of my own habits. I was using AI more and more in my daily work to scaffold ideas, develop code, organize thoughts, and find fresh perspectives on systems I was building. It had become part of how I worked. And I figured: if I'm using it this much, others are surely starting to experiment too. The difference? They might not understand what's happening with the information they're putting into these tools.
The numbers confirmed it. An Axios analysis of Q3 2024 data found that 45% of workers now use AI at work regularly, up from 27% just a year prior. OpenAI reports that 92% of Fortune 500 companies have employees actively using ChatGPT, and according to DeskTime research, it's the most commonly used AI tool, with 65% of workers having tried it on the job.
What's worth paying attention to: Harmonic Security found that 71.6% of generative AI access happens through non-corporate accounts. Personal subscriptions. Free-tier tools. Invisible to IT and security teams.
Why do employees turn to personal accounts? They want to work faster, and AI delivers. It can draft emails, summarize documents, debug code, and analyze data in seconds. When someone discovers they can cut an hour-long task down to ten minutes, they're not going to wait for IT to approve an enterprise license. They're going to sign up and start using it.
This isn't a problem to stamp out. It's an opportunity to channel.
Understanding the Data Exposure Risk
Every prompt entered into a personal AI account represents potential data exposure. This isn't about blame; it's about understanding how these tools work so you can make informed decisions.
Consider what gets typed into AI tools daily: customer names, financial projections, source code, meeting notes, strategic plans. Research from Cyberhaven found that 77% of employees have shared sensitive company data through AI tools. Harmonic Security's analysis showed that nearly 10% of all employee prompts contain sensitive information.
The Samsung incident in 2023 illustrates why this matters. Engineers shared sensitive data on three separate occasions within a single month, including source code, internal meeting notes, and hardware specifications. Each time, someone was just trying to do their job faster. Samsung's response was to ban generative AI tools entirely.
But outright bans aren't the answer for most organizations. They're difficult to enforce. They forfeit real productivity gains. And they push usage underground, which makes things worse.
The real question is what happens to that data. With free-tier AI accounts, your data is typically used to train future models. That means confidential information could influence responses given to others, or surface in unexpected ways. According to Harmonic Security's Q4 2024 analysis, 54% of sensitive data entered into AI tools goes through ChatGPT's free tier, which has no enterprise protections.
Here's the breakdown of what's being shared:
- 46% is customer data (billing information, authentication details)
- 27% is employee data (payroll, PII)
- 15% is legal and financial information
Existing privacy regulations still apply when data flows through third-party AI tools. In Canada, PIPEDA governs how organizations collect, use, and disclose personal information and that doesn't change just because the data passed through an AI. Quebec's Law 25 adds even stricter requirements. If you operate internationally or handle data from EU or US customers, GDPR and CCPA come into play as well. Your organization remains responsible for how that information is handled, regardless of where the AI server sits.
Building Your AI Usage Policy
When AI started appearing in mainstream news feeds, I knew we had a small window. Get guidance in place before problems emerged, or spend time cleaning up after them. The choice was obvious.
The goal was never to restrict innovation. It was to create clarity. And one principle guided everything: AI is an assistance tool, not a replacement. Human in the loop isn't just a nice-to-have. It's a core tenet.
I also wanted the policy written in plain language. Not legal jargon. Not technical documentation. Something people would actually read and understand. To make sure I was on the right track, I completed a micro-certification in Essentials of Responsible AI Governance through Toronto Metropolitan University. It helped validate the approach and filled in gaps I hadn't considered.
Start with information classification.
This is the foundation. Without it, every AI decision becomes a judgment call, and judgment calls don't scale.
I landed on a three-tier traffic light system. Simple. Visual. Easy to remember:
- Green: Information that's always appropriate for AI use (public content, general research, brainstorming)
- Yellow: Information that can be used with boundaries (internal processes, non-sensitive business data—but requires awareness of the tool being used)
- Red: Information that never goes into AI tools (customer PII, financial data, legal documents, proprietary systems, anything confidential or regulated)
The traffic light framing worked because people didn't need to memorize categories. Green means go. Red means stop. Yellow means think.
Define approved tools.
This is where you draw the line between managed risk and unmanaged risk.
Not all AI tools are equal. Enterprise accounts from major providers (ChatGPT Enterprise, Claude for Work, Gemini for Business) offer explicit contractual protections. Your data won't be used for training, and you get security features like SSO and audit logs.
Free-tier accounts typically use your data for model training by default. Most require manual opt-out, and even then, protections are limited.
Your policy should clearly state which tools are sanctioned, which require approval, and which aren't appropriate for work use.
Establish clear use cases.
This is what turns a policy from a document into daily guidance.
Help employees understand what's encouraged, what needs approval, and what's off-limits:
- Encouraged: Drafting initial versions of public communications, brainstorming ideas, summarizing public information, general research assistance
- Requires approval: Using AI for customer-facing content, any use case involving internal data
- Off-limits: Entering customer PII, financial data, legal documents, source code, strategic plans, or any confidential/restricted information
Include third parties.
Easy to overlook. Easy to regret.
Your contractors, agencies, and vendors are using AI too. Your policy should address expectations for anyone handling your organization's information.
Making It Work in Practice
Releasing a policy document isn't enough. It'll sit in a SharePoint folder and collect dust.
I developed video training materials that walked through everything: the why behind the policy, the traffic light system, real examples of what belongs in each category. Short. Practical. Something people could reference when they weren't sure.
Training and communication are essential. People need to understand not just the rules, but the reasoning. When employees understand how AI tools handle data and why certain guardrails exist, they make better decisions in the moment. Frame it as enablement: "Here's how to get the benefits of AI while keeping our data safe."
Lead by example. If executives use personal AI accounts for sensitive strategic planning while telling staff to follow the policy, the message is clear: the rules don't really matter. Leadership adoption of sanctioned tools signals that this is how the organization operates.
Plan to iterate. AI capabilities evolve monthly. Your policy should be reviewed bi-yearly at minimum. What was appropriate six months ago might need updating today. Build in a review cycle from the start, and treat your policy as a living document.
Clear Boundaries Enable Better Work
The organizations that will thrive are those that figure out how to harness AI's productivity benefits while managing the risks thoughtfully. That requires clear policies, sanctioned tools, and educated employees.
A good AI policy doesn't lock things down. It opens them up. When people know the boundaries, they can move faster within them. When there's ambiguity, they either take unnecessary risks or avoid AI entirely. Neither serves your business or your people.
